OPINION OF THE COURT

THIS CAUSE came before the Court on February 12, 1988 for an evidentiary hearing on Defendant’s Motion to Suppress based on an alleged unlawful stop of defendant’s vehicle. The Court having heard testimony therein, finds as follows:

The facts in the instant case show that Volusia County Sheriff’s Department Sergeant Larry Humm, on July 1, 1987, was proceeding *47west on State Road 40 approximately 2-3 miles west of the Tymber Creek residential area.
