This was an action by John "W. Gilliland against Nicholas V. Bilby, John S. Bilby, and Indian Land & Trust Company to quiet title to the S. W. % of section 5, township 6 north, range 9 east. The land in question had fallen to the heirs of a deceased member of the Creek Tribe of Indians whose name had been placed upon the rolls as a full-blood but who had died before receiving his allotments.

The plaintiff alleged that he was the legal and equitable owner of the land in question, but did not disclose his' chain of* title, but did allege that defendant Nicholas Y. Bilby…
