The issue before us in the instant adversary proceeding is whether the Defendant, the Debtor’s former accountant, who filed a Proof of Claim in this case prior to the institution of the proceeding in question and who failed in a motion to withdraw the reference of this proceeding to this district court, is entitled to a jury trial of this proceeding in this court.
