The matter in dispute is the boundary line between the plaintiff and defendants, adjoining owners of portions of the flats in the harbor of New Haven. They derive their respective titles remotely from the same grantors. In 1830 Henry Daggett, Elnathan Atwater, Abram Heaton and William Mosely owned the premises now owned by both parties, lying south of Water street. That street was originally two and one half rods wide, the south line of which was substantially the line of high water.
