WOODS, Circuit Judge.

This action to recover damages for breach of contract for the purchase of oil by the defendant from the plaintiff depended almost entirely on the construction of written contracts and letters. There was some variance in the evidence as to the market value of oil at the date of the alleged breach. The District Judge, construing the written evidence in plaintiff’s favor, directed a verdict for the difference between $1.50 a barrel, the contract price of 1,936,393 barrels of oil, and the market price, as the jury should find.
