OPINION OF THE COURT

JONES, Senior Judge:

This case is before this Court for review for the third time. A synopsis of the prior proceedings will be beneficial in understanding the issues currently pending.

The appellant was initially convicted by a general court-martial in Vietnam in March 1970 of unpremeditated murder, larceny, and assault with a dangerous weapon. He was sentenced to dishonorable discharge, forfeiture of all pay and allowances, con*406finement at hard labor for ten years and reduction to the grade of Private (E-l).
