Appellant Vaughn Childers 1 appeals from an order of the Pulaski County Circuit Court, which dismissed with prejudice his complaint for failure to comply with Arkansas Code Annotated section 16-114-209 (Repl. 2006). Childers raises two points of error: (1) that the circuit court erred by finding that the affidavit he submitted was insufficient to comply with section 16-114-209, and (2) that the circuit court erred by failing to determine that section 16-114-209(b), in its entirety, was unconstitutional.
