—In an action to recover damages for medical malpractice, the defendant appeals from an order of the Supreme Court, Kings County (Levine, J.), dated March 31, 1998, which denied his motion for summary judgment and for leave to amend his answer to assert the affirmative defense of release.
Ordered that the order is modified, by deleting the provision thereof which denied that branch of his motion which was for leave to amend his answer to assert the affirmative defense of release, and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed,…
