HENNING, District Judge.

This is an , application for probation on behalf of the defendant. The defendant, with, others, was charged with, a violation of section 215 of the Criminal Code (Comp. St. § 10385), by having operated a fraudulent scheme through the use of the mails. The trial was had before my predecessor in office, Hon. Benjamin F. Bledsoe.

The accused took an appeal from the judgment of conviction, but no reversal was had. U. S. v. Nix (C. C. A.) 4 F.(2d) 652. A petition for review was refused by the United States Supreme Court.
