Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life.

The first error discussed in appellant's brief is the following portion of the charge of the court: "Should you find that R.H. Moseley, or any other person other than defendant, cut deceased Clyde Yoe with a knife, which resulted in the death of deceased Yoe, then you will acquit defendant, and return a verdict of not guilty."
