This prosecution originated in the municipal court of Birmingham, wherein appellee was charged by affidavit with the offense of violating the terms of the statute approved September 30, 1919 (Acts, 1919, p. 1088), known as the antiprofiteering act. From a judgment of conviction in said municipal court, the defendant appealed to the circuit court, and was there put to trial upon a complaint filed by the solicitor.
