This court granted a writ of certiorari to bring up for review a judgment of the Appellate Court for the Third District affirming a judgment of the circuit court of McLean county in favor of defendant in error against plaintiffs in error for $2468.60. The action was based on the Statute of Frauds and Perjuries. (Cahill’s Stat. 1925, chap. 59.) Pleadings were waived and the cause was submitted to the court without a jury, upon an agreed statement of facts set forth in a stipulation filed.
