MEMORANDUM OPINION AND ORDER
CANCIO, Chief Judge.
Plaintiffs filed a motion for a partial summary judgment on the issue of liability and through clerical inadvertence plaintiff’s brief which accompanied his motion for summary judgment was not brought to the Court’s attention. Thus, on September 20, 1973 this Court denied plaintiff’s motion for partial summary judgment without having the benefit of plaintiff’s brief.
