This action grew out of the shipment of a carload of horses by appellee from Collins, Montana, to Lebanon, Tennessee, over the respective lines of an initial, .a connecting and a terminal carrier, appellant, whose line extends from Nashville to Lebanon, Tennessee, being such terminal car*420rier. On the arrival of the horses at Lebanon, appellee issued to appellant’s agent, for freight charges on the carload of horses, a check, dated November 3, 1909, drawn on the Franklin National .Bank of Franklin, Indiana, in the sum of $382.13.
