*1720Appeal from an order of the Supreme Court, Niagara County (Richard C. Kloch, Sr., A.J.), entered June 10, 2008 in a proceeding pursuant to EDPL article 4. The order, inter alia, granted the motion of respondents Dino DiCienzo, Intertrust Development, Inc. and Niagara Falls Urban Renewal Agency for distribution of the advance payment to them pursuant to EDPL 304.

It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
