The issue for decision in this case is whether the dismissal of the plaintiff probationary police officer from the defendant city’s police force was unlawful. Plaintiff was dismissed from the police department for failure to satisfactorily complete his one-year probationary period due to a non-job-related injury occurring in the eleventh month of the probationary period.
