The statute by virtue of which Union street was repaved and the assessment therefor sought to be vacated was made (Laws of 1868, chap. 460), provides that the expense of the improvement “ shall be levied and collected m the same manner as now provided by law with reference to grading and paving streets in Brooklyn.” The provisions of law thus adopted are contained in the charter of the city. By section 33 of title 4 of the charter, provision is made for an assessment by the board of assessors of the expense of the grading and paving streets upon the several lots, pieces or parcels of land…
