Appeal by the plaintiff, the United States Casualty Company, from an order of the Supreme Court, made at the Hew York Special Term and entered in. the office of the clerk of the county .of Hew York on the 3d day of June, 1907, granting, the defendant’s motion for a bill of particulars.

This action was brought to recover certain advances alleged to have been made by plaintiff to defendant in excess of commissions to which he and his sub-agents were entitled and also upon a separate cause of action for money loaned. After the action had been commenced, but before issue was joined-, the defendant moved for a bill of particulars.
