Alexander Gay was tried in the Criminal Court of Atlanta upon an accusation charging him with 'the offense of abandoning his child, leaving her in a dependent and destitute condition. The accused filed pleas of former conviction and not guilty, and the issues thus arising were, by consent, submitted to the decision of the judge without a jury, upon ah agreed statement of facts, which was, in substance, as follows: Accused is the husband of Sally Gay.
