The plaintiff, Walter V. Love (“Love”), alleges the Defendant, J.P. Cullen & Sons, Inc., (“Cullen”) discriminated and retaliated against him based on race in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (Amended Complaint, Docket # 17.) Before the court is Cullen’s motion for summary judgment arguing that Love was not its de facto or indirect employee for Title VII purposes. (Docket #21.)
