HIGGINS, Justice.

The accused was indicted, tried, and convicted of the crime of cattle stealing, and was sentenced to serve from fifteen to thirty-six months in the State Penitentiary. He filed a motion for a new trial on the ground (1) that the verdict of the jury was contrary to the law and the evidence, and (2) that, since his conviction, he had discovered new evidence, consisting of the proposed testimony of three witnesses, to the effect that after the alleged stolen heifer or yearling had been taken from Avoyelles Parish to Alexandria, Rapides Parish, and disposed of, these witnesses…
