BROWN, Justice.

The facts and circumstances attending the appellant’s application for a postponement of the trial clearly differentiate this case from the case of City of Birmingham v. Goolsby, 227 Ala. 421, 150 So. 322.

In that case it appeared that the defendant had only one attorney of record who was then actually engaged in the trial of another case in the same court, the circuit court of Jefferson county, which had been on trial for several days. It did not appear that the defendant had on the docket many cases — more than could be handled by one trial lawyer, without impeding the business…
