Jeraldine Herbin brought this action on behalf of her grandson, Jervon Herbin, seeking review of an independent hearing officer’s decision in an administrative due process hearing held on plaintiffs allegation that the defendants, the District of Columbia and the Superintendent of the District of Columbia Public Schools (“DCPS”), failed timely to provide her requested special education services reevaluation of Jervon under the Individuals with Disabilities Education Act (“IDEA”), 20 U.S.C. §§ 1400-1487 (2000).
