" Appeal by the defendants, Henry B. Beecher and another, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 2d day of January, 1896, upon the decision of the court rendered after a trial at the Hew York Special Term overruling the defendants’ demurrer to the plaintiff’s complaint.

This action is brought against the defendants, Henry B. Beecher and Vincent R. Schenck, upon a contract of insurance made between the plaintiff on the one part and these two defendants as agents for certain underwriters, doing business under the name and style of the Metropolitan Lloyds of Hew Tork'city. The complaint does not contain the contract in the precise words in which it was written,, but it sets up the contract according to its tenor.
