In an earlier stage of this litigation, the Supreme Court held that the Little Tucker Act, 28 U.S.C. § 1346(a)(2), does not waive the sovereign immunity of the United States in a suit seeking to collect damages for an asserted violation of the Fair Credit Reporting Act (FCRA), 15 U.S.C. §§ 1681-1681x. United States v. Bormes, — U.S. -, 133 S.Ct. 12, 184 L.Ed.2d 317 (2012).
