I. INTRODUCTION

This matter comes before the Court on Motions for Summary Judgment brought by Plaintiff United States of America (“Government”) and Defendants Rhody Dairy L.L.C. and Jay L. De Jong (“Defendants”) (Dkt. 11, 18), and on the Government’s request for injunctive relief pursuant to 21 U.S.C. § 332(a) of the Federal Food, Drug, and Cosmetic Act (“FDCA”). Dkt. 11.
