The defendant in error instituted suit against the plaintiff in error in the lower court to recover judgment for personal injuries alleged to have been received by him while in the employ of the company, and it is claimed that the same were due to or caused by the negligence of the plaintiff in error, in that: First, it failed to furnish a reasonably safe place in -which to work; second, that it failed to furnish reasonably safe instrumentalities; third, that it failed to furnish reasonably competent and trustworthy fellow servants.
