This is a condemnation case.

The State of Texas and the County of Brazoria are the condemnors and J. B. Arthur is the owner of the land condemned. The land taken was 1.7 acres out of a 2.8 acre tract described as Tract 168 of Division No. 14, Brazos Coast Investment Company Subdivision of the Alexander Calvit League, Abstract 49. The tract of property involved was unimproved and was located at the intersections of State Highway 288 and State Highway 332 in Brazoria County, Texas.
