This is an appeal from a judgment in the district court of Collin county for the sum of $5,000. The suit was instituted by appellee, F. F. Diskeroon, against appellant, Louisiana Railway & Navigation Company of Texas, to recover damages by reason of two injuries received by him while he was in appellant’s employ. The first injury is alleged to have occurred in January 13, 1925, while appellee was riding on a hand car being operated by himself and other members of the section crew; .This injury was to appellee’s knee.
