Claude E. Rabb, executor of the estate of Harry W. Rabb, appeals the grant of summary judgment by the United States District Court for the Western District of North Carolina based upon the court’s preclusion of Rabb’s critical evidence in his asbestosis-related action for failure to comply with the court’s pre-trial order.
