OPINION
SWEET, District Judge.
Defendants Victoria’s Secret Catalogue, Leslie H. Wexner, Edward G. Razek, Cynthia Fedus and Betsy Hendrickson (collectively, “VSC”) moved pursuant to Rule 12(b)(6) and Rule 9(b), Fed.R.Civ.P., to dismiss the First Amended Complaint filed by Plaintiff Denise Katzman (“Katzman”) for failure to state a claim, and pursuant to Rule 11, Fed.R.Civ.P., for sanctions. Katzman moved pursuant to Fed.R.Civ.P. 15 to serve and file a Second Amended Complaint.
