The petitioner, Helen Hillibush, appeals from a decision of the Department of Labor’s Benefits Review Board (“the Board”) affirming an administrative law judge’s denial of her benefits under § 21(c) of the Longshoremen’s and Harbor Workers’ Compensation Act of 1927, 33 U.S.C. § 921(c) (1982), as incorporated by § 422(a) of the Black Lung Benefits Act, 30 U.S.C. § 932(a) (1982). The respondent, the Director of the Department of Labor’s Office of Workers’ Compensation Programs (“OWCP”) seeks a remand of this case to the Board. This…
