On the 21st day of May, 1913, Otto Meyer sold two lots in the .city of New Braunfels to appellant for the sum of $1,200, at which time he was paid by appellant $100, for which he executed a receipt. Thereafter, on the 2d day of July, 1913, he executed a deed to Floegge for said lots, which was placed by them in the hands of an abstractor, and before it was delivered to Floegge, Henry, a brother of Otto Meyer, without the consent of appellant, obtained possession thereof and refused to surrender same, and this suit was brought by appellant for the possession of said deed and for •title to said…
