The ruling of the court striking from the files the amended complaint must be upheld. The original complaint alleged as a considera tion for the contract upon which it based its complaint to be the agreement upon the part of the defendant and his associates to jointly defend an action brought by Walch against the plaintiff, his associates and the defendants in this suit, for damages alleged to have been sustained in the sale of the Schwebke land.
