This action was brought by the plaintiff, H. D. Lambert, against the defendant, the Railway Company,- to recover $1,999 for failure to deliver a car load of horses and mules, shipped from Seligman, Ariz., to Muskogee, Okla.; it being alleged that the}' were allowed to escape from the custody and control of the Railroad Company at Gallup, N. M. ■ The plaintiff was a resident of McIntosh county.
