OPINION AND ORDER
BESOSA, District Judge.
At a pre-trial conference on September 19, 2007, the parties discussed whether the Court had jurisdiction to hear the case considering alleged deficiencies in the plaintiffs’ claim under the Emergency Medical Treatment and Active Labor Act (“EMTALA”) (Docket No. 189). The Court then ordered the defendants to file a motion for summary judgment on this issue (Id.).
