This matter is before the Court on defendant Angel M. Washington’s Motion to Dismiss this habitual offender proceeding. Washington claims that the Fifth Amendment Clause of the United States Constitution precludes the Commonwealth from attempting to have him declared an habitual offender. The Court held a hearing, at which the parties stipulated to the evidence, and then took this matter under advisement.
