On this date, the Court considered Defendant’s Motion to Dismiss (Docket Entry No. 5), Plaintiffs Amended Response *733(Docket Entry No. 7), and Defendant’s Reply (Docket Entry No. 8). For the following reasons, Defendant’s motion to dismiss is DENIED.
