THE COURT.

—We review the recommendation of the State Bar Court that petitioner David Eric Brockway be suspended from the practice of law for one year, that execution of the order be stayed, and that petitioner be placed on probation for two years on various conditions, including actual suspension for three months.

We uphold the State Bar Court’s findings that petitioner misappropriated funds from one set of clients, and acquired an adverse interest in another client’s property without following pertinent disclosure and consent requirements. However, we do not agree with the State Bar…
