This proceeding is instituted by the applicant, Edward D. Peters, for an order directing that a "peremptory writ of mandamus issue, directed to the defendant as comptroller of the city of Buffalo, requiring him to countersign and deliver to the applicant a warrant of $1,026 directed drawn in favor of the applicant by the common council of the ci-ty, with the approval of the mayor, and which the comptroller refuses to countersign or to deliver.
