Action to recover from the defendant the sum of $2,700 which the complaint alleges that the plaintiff loaned to the defendant at its request. The defendant in its answer set up several counterclaims, and the plaintiff demurred to the third one on the ground that it did not *24allege facts sufficient to constitute a counterclaim. The trial' court made its order sustaining the demurrer, from which the defendant appealed.
