This case comes before us on a writ of error to the circuit court of Warren county upon the judgment entered upon a verdict finding the plaintiff in error guilty of the crime of murder, and fixing his punishment at a life sentence in the penitentiary at Joliet.

The record discloses that Charles Collins, the plaintiff in error, resided at Monmouth with his wife, Hattie A. Collins, and his three daughters, aged, respectively, eight, ten and thirteen years; that he had resided there for many years, and of recent years had become a prey to the excessive use of intoxicating liquors; that this habit…
