OPINION

RIORDAN, Justice.

Defendant Ibn Omar-Muhammad (defendant) was charged with the first-degree depraved mind murder of Allen Gates Cross (Cross). The case was originally brought in the Children’s Court Division in. the Curry County District Court. After several hearings, the case was transferred to the criminal docket of the district court. After a jury trial, the defendant was convicted and was sentenced to life imprisonment. The defendant appeals. We reverse and remand for a new trial.
