Appeal by the plaintiff, Everett M. Kennedy, as executor, etc., of Harvey Kennedy, deceased, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 16th day of January, 1896, upon the verdict of a jury rendered by direction of the court after a trial at a Trial Term of said court.

Rumsey, J.:
The action was brought to recover a balance due to the plaintiff upon closing out a stock account between the plaintiff’s testator and the defendant. The case is presented to us upon a bill of exceptions, the plaintiff having with great care inserted only so much of the evidence as is necessary to show precisely the rulings made and the questions which-are sought to be presented upon the appeal.
