April 21, 1930, plaintiff entered into a contract with the defendant, Skagit county, for the construction of a highway. Prior thereto, the county had made a call for bids, wherein it was stipulated that contractors, before submitting bids, must examine the site of the proposed work and the proposed plans and specifications. Plaintiff, having complied with this requirement, submitted its bid. The proposed highway ran along the Skagit river in the Cascade mountains.
