This appeal arises out of proceedings in the circuit court of Jackson County brought by the City of Kansas City, Missouri, (sometimes hereinafter referred to as “the City”) under its Ordinance 17161 providing for the condemnation of certain real estate “for public use for an armory site.” The landowner’s challenge to the authority of the City to condemn his land was overruled, and after a hearing, compensation for the taking in the amount of $42,000 was ascertained and assessed by a jury of six disinterested freeholders.
