MEMORANDUM

DALZELL, District Judge.

I. Introduction

We consider here defendants Township of Upper Darby (“the Township” or “Upper Darby”) and Officer William Sides’s motion to dismiss plaintiffs amended complaint pursuant to Fed.R.Civ.P. 12(b)(6).

*733Robert J. Boyden, Sr. brings this action against the defendants pursuant to 42 U.S.C. § 1983 and state tort law claiming that the defendants violated his Fourth Amendment rights by using excessive force when arresting him, and that in doing so Officer Sides also committed assault and battery on Boyden.
