On September 19, 1917, and for a considerable time previous to that date, the defendant was engaged in the manufacture and sale of ice cream and confectionery in Greenfield, maintaining a place of business where he received orders for .and manufactured and sold his products. He had a motor .truck, which he used solely in the delivery of ice cream, and which he left in front of the store when he went away on the day stated.'
