Appellant sued appellee on a promissory note whereby, as alleged in the complaint, he, on February 1, 1892, promised to pay, one year after date, to Fennetta Palmer, of Logansport, Indiana, at the State National Bank of said city, $1,000, with interest at seven per cent per annum and attorneys’ fees. The complaint further avers that after the execution of the note in suit Fennetta Palmer died testate at Oass county, Indiana, and that plaintiff, appellant herein, and Rose J.
