Third-party claimant/appellant, Frank Pizzuro, appeals from the judgment of the Shaker Heights Municipal Court in favor of plaintiff-appellee, McKinley Federal Savings and Loan.

Appellee bank was a judgment creditor of third-party claimant/appellant’s brother, the defendant/judgment debtor, Battista Pizzuro. The judgment was rendered by the Trumbull County Court of Common Pleas and was subsequently transferred to the trial court on July 8, 1988 in the amount of $268,899.45.
